(Employers Capabilities) (England) Regulations 2010

Additional legislation of the Regulatory Reform (Fire Safety) Order 2005 was released on the 6th of April 2010. A purely technical article, it states the employer must consider what a worker or employee is able or unable to do when delegating responsibility for fire related risks.

It reinforces the duty that the Regulatory Reform (Fire Safety) Order 2005 indicates, that staff must have 'sufficient training and experience or knowledge' (RRO). So, employers will now have to think about what a worker is able and unable to do when delegating those tasks and how these capabilities may affect their ability to deal with fire related risks. This includes fire risk assessments and nominated fire wardens or marshals.

The RRO remains the foremost legislation concerning all sectors of fire safety and these additional regulations should not add any further burden of responsibility. It merely highlights what may previously have been unclear.

A fire risk assessment is legally required in any non-domestic premises, subject to the Regulatory Reform (Fire Safety) Order 2005. Failure to record an assessment, performed by an accredited assessor may result in a planning enforcement notice or prohibition notice. In the event of a fire, proof will be needed of having taken appropriate steps to ensure the safety of everyone on the premises.

Many of these steps are common sense, but some are harder to define and satisfy. Are fire procedures in place, and do you have a fire plan? You will also need to establish that emergency escape routes are accessible and clearly signed. Do you have emergency lighting - does it work? What is your means of raising the alarm or means of fire fighting? You will need to ensure that all of your fire equipment is maintained and up to date and that all of your staff have had adequate fire training. As well as these more obvious steps, you will need to check and maintain all electrical appliances, making sure that they are appropriately PAT tested and tagged. Failure to comply can lead to a fine. Periodic testing of mains electrical intake, distribution boards and electrical circuits are also required every five or ten years. Your Responsibility and Liability

'Responsible Person' is the FSO term applied to the individual given the job of ensuring that a fire risk assessment is carried out for "...any non-domestic premises in England and Wales, including the common parts of blocks of flats and houses in multiple occupation (HMOs)..."

However, confusingly perhaps, the responsible person may not be liable if the worst happens. Ultimate responsibility and liability will usually lie with one person or entity who may be the owner of a business, property or flats (e.g. the landlord), the managing director of a company, or the occupant of a flat (if they've purchased the freehold). That ultimate liability is often misunderstood, and so are the consequences. For example they could go to prison if, in the event of a fire, it is proved that either they did not have a fire risk assessment in place or that they have failed to carry out the recommendations of a fire risk assessment.
